Jury Awards $7.25 M to Girl Injured by Faulty Cochlear-Ear Implant

An 11-year-old girl who was thrown to the ground, vomitting and convulsing from a shock caused by her cochlear-ear implant on multiple occassions was awarded $7.25 million — including $6.25 in punitive damages — by a Kentucky federal jury.

The suit, brought against the device manufacturer Advance Bionics for injuries suffered by Breanna Sadler when she was shocked by the electronic hearing device, which was implanted into her skull. The device is in use in more than 4,000 people, most of them children, and Breanna Sadler's case was the first of 40 lawsuits against Advance Bionics to go to trial.

The suits allege that Advanced Bionics failed to properly test the safety of the device before selling it to the general public and that the company knew the device leaked and was defective but sold it to the public anyway.
