Multi-Billion Dollar Settlement Announced on DePuy ASR Hip Implants

Individuals who have suffered revision surgeries and pain and suffering from DePuy’s flawed ASR Hip Implant stand to receive a settlement – as DePuy parent company Johnson & Johnson has agreed to pay about $2.5 billion to compensate 8,598 patients.

The New York Times reports that, under the settlement agreement, Johnson & Johnson will cover an additional $3 billion to cover medical costs of the procedures.

This settlement seeks to address the claims of those ASR patients who have undergone a revision surgery as of August 31, 2013 and allows ASR patients who have yet to undergo a revision surgery to maintain their legal rights.

The deal was announced in open court on November 19, when the federal district court judge overseeing, MDL 2197, the DePuy ASR multi-district litigation, Hon. David A. Katz in Ohio held a hearing to consider the proposal.

In order to finally settle, at least 94% of the eligible claimants must agree to the deal.  In order to particpate, a patient must be a U.S. citizen or resident who has had the ASR XL Acetabular Hip System or the ASR Hip Resurfacing system implanted in a U.S. Hospital or U.S. Military Hospital. The typical patient will receive about $250,000 before attorneys fees are calculated.
