Recently the federal appeals court for the Tenth Circuit “upheld the Food and Drug Administration’s (FDA) final rule declaring all dietary supplements containing ephedrine alkaloids adulterated, and therefore illegal for marketing in the United States. . . ” The FDA had issued the rule in 2004 after intensively evaluating scientific evidence on ephedrine alkaloids. The sale of any supplements containing ephedrine alkaloids is illegal in the U.S.
